Prior to using or accessing our services, it is important that you carefully review the terms and conditions set out below (herein referred to as the "terms"). Additionally, you are also advised to periodically review and check our terms to ensure that you have been kept on the most updated version of these terms.

Upon your commencement in the usage of our service, it is deemed that you have read and accepted the Terms set forth herein, hence forming a legal and binding agreement between FotoHub Pte Ltd., (herein referred to as "FotoHub", "we", "us", "our" and their affiliates) and yourself pursuant to which you agree to comply with the Terms of Service, and use this website only in a manner consistent with the Terms of Service. However should you disagree with any part of this Terms of Service, you are kindly advised not to access this website.

Your Account

When accessing our service, you must provide FotoHub with full, complete, true and accurate information about yourself upon request.  The request may be via questionnaires, surveys, registration forms, or other informational requests.  Periodically, you must also keep that information updated so it is current and accurate. You are responsible for keeping your account and password strictly confidential, for restricting access to your account, and for all activities that occur under your account or password. In the event of any actual or suspected unauthorized use of your account, you are to notify FotoHub immediately.

Your Content

When using our online editor to design your products such as photobooks, calendars, etc., you may use JPG, JPEG, TIF, or PNG file format that meets our specifications and necessary requirements. In accessing our service to design your products, there is no limitation on your using of photographic images and texts, files, works of authorship, illustration and drawings as part of your use of the Service.

Under these terms of service, you will without exception strictly NOT ALLOWED to use any of the services for any fraudulent or illegal purposes, and additionally, you MUST NOT input any of the following material/content using the service:

a) Any material/content that could infringe on the rights of publicity, privacy or copyrights without the approval and consent of the content owner;

b) Any material/content that could infringe and deemed to be unlawful, obscene, pornographic, indecent, defamatory, offensive, abusive, threatening, or otherwise inappropriate and harmful to children and public at large in any way, or could give rise to any civil or criminal liability under applicable law;

c) Any material/content that contains viruses, worms, corrupt files, Trojan horse or other sorts of corrupted codes.

d) Any material/content that is offensive or promotes racism, bigotry or hatred against any group or individual.

FotoHub reserves the right at its sole discretion to move, refuse to print and delete any material/content that is believed to be as described in paragraphs (a) through (d) above, or otherwise deemed unacceptable. You further acknowledge and agree that any submission may be published, copied, customized or removed for the purposes of delivering the terms of service. In addition, you will undertake to be liable for any action taken against FotoHub in relation to such activities and will fully indemnify FotoHub against all actions, claims, demands or costs which may arise as a result.

FotoHub has no ownership in any of your book content. As a good practice, you should always retain your own copies of all files uploaded or otherwise supplied to us. We strongly recommend that before submitting your files to us, you retain a copy for yourself to use for future re-ordering, or in the unlikely event of your digital images being corrupted or lost.

Protection of intellectual property rights

The content on the website, including but not limited to works, pictures, files, information, data, website structure, website screen arrangement, web design, are all made by "FotoHub" and/or other right holders that have their intellectual property rights according to law, including but not limited to trademark rights, patent rights, copyrights, business secrets and proprietary technologies. You are not allowed to use, modify, reproduce, publicly broadcast, rewrite, distribute, publish or carry out any restoration works. If you want to quote or reprint the aforementioned on the website content, you must obtain the official written authorization of "FotoHub" or other rights holders according to law.

The copyright of the pictures, text, layout, style, illustration and other objects used in the editing software and website of "FotoHub" is owned by "FotoHub"; the uploaded photos, text, objects such as cliparts are owned by "FotoHub"/original editor, and both parties shall be legally responsible for the sources and copyrights of the materials they provide. You confirm and agree that the content (such as photos, illustrations, text, etc.) used by the products you arrange yourself is not owned by a third party. If there is any illegal or infringing behaviour, the consumer shall be fully liable for damages, and there can be no objection to this.

Our Order Policy

Receipt of an electronic order or other forms of order confirmation by no means signify FotoHub’s acceptance of your order, nor does it constitute confirmation of our offer to sell. FotoHub reserves the exclusive right at any time after receipt of your order, to accept or decline your order for any reason. We may also require additional verifications or information before accepting any order.  Your order is deemed accepted by FotoHub upon our delivery of the products that you have ordered.

Note that content cannot be modified, changed or revised once your product design order has been uploaded onto the website. FotoHub has no obligation to review the content that you have submitted and hence you hereby agree that your project has gone through the necessary proofs and checks until fully satisfied and that it is ready to be published.

We are not responsible for any customer-generated mistakes, such as but not limited to, missing or images, alignment and border issues, spelling and spacing errors, missing or incomplete files, etc. Once the file has been successfully uploaded into the system and the order is submitted, we do not accept any further amendments or changes. We therefore strongly suggest customers to thoroughly check their proofs before uploading their books.

Fee and Payment Terms

All prices are in their respective local currencies and payment must accompany each order. No charges will be imposed for browsing or accessing our website. Prices, products and services offered may be subjected to changes without prior notice at our sole discretion upon posting by FotoHub on its website(s). Please refer to our product price list for complete listings.

You hereby agree to pay all fees and charges incurred in connection with your orders which include without limitation taxes, duty imports, value-added taxes and customs clearance, if any. Payment terms will be via online credit/debit card transactions, our official merchant of payments, or unless otherwise stated. We reserve the right to refer to your credit card provider. FotoHub will not be held liable for any losses you may suffer as a result of unauthorized use of your credit card by any other party. An electronic sales order confirmation will be sent to your email address once your order has been captured into our system.

Delivery of Products

If delivery service is selected during the order process, then all products or prints will be delivered to the delivery address given by you. You are to note that time for delivery is only an estimate and it is not a condition of this agreement. Delayed delivery is not a basis for cancellation of an order or a request for compensation. Orders may be refused at the discretion of FotoHub if we believe that there is any infringement to this terms of service.

Product Guarantee & Warranty

FotoHub is proud of the outstanding quality and craftsmanship of our products and provides 100% Satisfaction Guarantee* against any manufacturing defects. Refunds and cancellation of an order are generally not provided except for cases of process or product malfunction (eg. workmanship defect, book arrives damaged, product do not match ordered items).

In the production of your book, FotoHub reserves the right at any time to substitute/change brand as well as the material used without prior notice. In cases of material shortage, we will substitute by using the next best alternative material of the closest quality and specification.

As our photobooks are largely hand-assembled, the final product may differ slightly from our website images. FotoHub also reserves the right to change or alter any of its production process and/or methods without prior notice.  While these changes may or may not result in a marginal difference in the final product outlook, they will not be at the sacrifice of the FotoHub’s same high quality and standards.

IMPORTANT: Please note that once the file is already uploaded, we do NOT accept any further amendments or changes to be made to the file. Therefore, it is the sole and complete responsibility of the customer to check his/her file thoroughly before finalizing and ordering their project(s).

Please preview your books carefully before placing your order. Images and text will be printed as they appear in the Preview. We do not proofread for, or correct, any such customer generated mistakes.  Please note that FotoHub is not responsible for customer-generated mistakes, errors or defects including spelling, typographical or grammar errors, poor image quality derived from low-resolution images, order quantity or other ordering errors.

Should there be any dissatisfaction with our product, kindly contact our customer service in writing together with a picture or pictures of the problem/areas of dissatisfaction. We will objectively assess the condition of the item(s), and at our sole discretion to either repair or replace the product(s) that does not meet the warranty or condition. All complaints on the defective product(s) must be submitted within 3 days upon receiving your product(s).

Legal Age Requirement

There is no legal minimum age imposed to access this website but we strongly advise that anyone below the age of 16 are to obtain parental consent when using our services as well as for the submission of any credit card information when in the process of placing an order. We also strongly recommend that parents and guardians supervise their children’s use of our website.

Third-Party Links

In our website, we may at our discretion provide links to third party sites that may be of interest you. However we emphasize strongly that whilst we review the appropriateness of these site before providing the links, we do not have control over the content or availability of these said sites.  We are also not responsible for any content in the said third party sites. It is your responsibility to read and understand each site’s privacy and the respective policies and terms and conditions of their service. In the event of any questions or concerns regarding these third-party sites, you are to contact the respective site’s webmaster or site administrator.

Acceptance of Agreement

YOU HEREBY ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS STATED HEREIN. FotoHub reserves the right, at our sole discretion, to update or make amendments and modifications to this Terms of Service from time to time without prior notice.
